One Big Beautiful Bill Act: New federal law allows workers to deduct FLSA-mandated overtime premium from their taxable income at year-end. This tool tracks which overtime qualifies:
FLSA-Qualifying OT: Hours worked over 40/week (federal threshold) - Premium is tax deductible up to $12,500/$25,000
Non-Qualifying OT: State daily OT that doesn't exceed 40 hrs/week (e.g., CA employee works 10hrs Mon, 6hrs Tue-Thu = 34hrs total) - NOT tax deductible
Important: Overtime is still subject to normal withholding during payroll. The deduction is claimed on the employee's tax return. Employers must report the qualified premium separately on W-2 Box 14. PTO/Sick time is excluded from OT calculations but included in gross pay.
